I hereby acknowledge and agree that participation in lessons, clinics, camps; and participation in all activities conducted within the Park City Baseball Academy facilities as well as off-site activities sponsored by Park City Baseball Academy have inherent risks.
In consideration of the services provided by Park City Baseball Academy, their agents, officers, participants, consultants, employees, and all persons or entities acting in any capacity on their behalf (hereinafter referred to as “PARK CITY BASEBALL ACADEMY”) I now agree and certify as follows:
By signing this document, I acknowledge that if anyone is hurt, or property is damaged during participation in this activity a court of law may find me to have waived my right to maintain a lawsuit against the “PARK CITY BASEBALL ACADEMY”, and any of the other parties associated with the “PARK CITY BASEBALL ACADEMY” on the basis of any claim from which I have released them herein.
The undersigned participant, hereby represents and warrants that he/she has no medical conditions or physical disabilities that would prevent Participant from participating in any physical activity, including but not limited to exercising and physical exertion, and that Participant is in good physical condition and not currently under a doctor's care.
Participant further understands and agrees that his/her participation at the PARK CITY BASEBALL ACADEMY is at his/her own risk and he/she hereby agrees to release, indemnify, discharge and hold harmless, absolutely, unconditionally and forever PARK CITY BASEBALL ACADEMY and any successors-in-interest, their parents and any of their affiliates, subsidiaries and their respective officers, directors, representatives, agents, or employees, from any and all liability by reason of any and all claims, actions, suits, proceedings, costs, obligations, losses, expenses, damages and liabilities, including a) injury to or death of any person(s); b) damage to or loss of any equipment, materials or other personal property; or c) reasonable attorneys' fees arising out of, connected with or resulting from any and all claims of whatsoever kind or nature that may occur as a result of Participant's involvement and participation at the PARK CITY BASEBALL ACADEMY located at 4554 N. Forestdale Dr., Park City, UT 84060.
Use of Likeness
Participants and his/her parents or guardian hereby authorize “Park City Baseball Academy” and its assigns to use any and all photographs, pictures, videos or other likenesses of participant in its promotional materials or social media platforms.
Park City Baseball Academy Rules and Regulations
Your job is To HAVE FUN, but be safe while you are at the “Park City Baseball Academy” facility - and in an effort to reduce the potential for injury, we ask that you become familiar with and abide by the rules below and, even more importantly, keep all your activities and movements within your own personal limitations and comfort level. DO NOT ATTEMPT anything that you are not capable of without supervision/spotting/safety checks. Employees help ensure that rules and regulations are followed. Participants should not participate without an employee present. In addition:
+ Fees must be paid and a waiver form must be signed before using the facility. If participant is under 18, a parent or legal guardian must sign the waiver form.
General Rules
1. Helmets must be worn by all hitters and feeders entering the batting cages.
2. Anyone throwing batting practice and/or pitching to batters must situate themselves behind a protective L-screen.
3. A maximum of two people are allowed in any batting station at any time. These two people would be (a) a batter wearing a batting helmet and (b) a pitcher throwing behind the protective L- screen.
4. Any person entering the facility is expected to use common sense and maintain a proper lookout for their own safety.
5. Machines are not to be adjusted under any circumstances by anyone other than a Park City Baseball Academy representative. Machine needs to have a screen in front of it when hitting tee/front toss. Machine feeder needs to wear a helmet.
6. Only authorized personnel are allowed to run the Rapsodo/radar systems.
7. Park City Baseball Academy is not responsible for lost or misplaced personal property.
8. Sneakers and turf shoes are the only footwear items permitted in the training area. No metal or molded cleats are allowed.
9. Exercising in the weight room must be supervised by an adult. Spotters must be used for dumbbells/barbells. Weights must be re-racked. NO DROPPING WEIGHTS. User is responsible for damaged/broken equipment due to misuse or lack of care/focus.
10. NO SWINGING OUTSIDE OF BATTING CAGES.
Food or Drink
1. Only water and sports drinks are allowed at Park City Baseball Academy. No other food or drink of any type may be brought into the facility.
2. No gum or sunflower seeds may be chewed while in the PCBA facility.
3. No cigarettes or other tobacco products may be brought into the PCBA facility.
Behavior
1. No person shall pull, hang onto or harm any of the netting in the batting cages and/or surrounding the training area.
2. Horseplay or inappropriate behavior is not tolerated.
3. No throwing balls outside of caged area inside the PCBA facility.
4. No SPITTING is permitted within the indoor portion of PCBA.
5. Place trash in appropriate receptacles.
6. Respect the facility. Leave things better than you found them!!
Failure to adhere to the “Park City Baseball Academy” rules can/will result in the loss of facility privileges.
