HIS RELEASE AND WAIVER OF LIABILITY (hereinafter referred to as the " Release" )

by the undersigned adult( s) on behalf of mself or herself and any and all minor( s) , as the parent or guardian if said minor( s) having legal custody and responsibility for the minor( s) ( hereinafter collectively referred to as " RENTER" ) , in favor of RACE DREAM JET SKI RENTALS, (hereinafter collectively referred to as the " LESSOR/ OWNER" ) , their respective directors, officers and agents. The term " LESSOR/ OWNER" is of no significance and is used for the sake of convenience and brevity.

By booking your rental with Race& Dream Jet Ski Rentals, you are acknowledging that you have no physical or mental disability or condition that would prevent or affect your ability to safely operate the rental equipment. You are authorizing Race Dream Jet Ski Rentals to charge your credit card on file for any damages to the equipment, in addition to any applicable rental charges, booking fees, other taxes and fees, fuel surcharges, or other incidentals. In the event of damage, the credit card on file be used to cover all damages to the equipment. The Renter will be responsible for all other related costs, including but not limited to the actual or estimated costs of repair for physical damage to the equipment, cost of recovery to equipment/ passengers, towing fees, staffing costs to trailer equipment to repair facility, and lost rentals. Race Dream Jet Ski Rentals will have the damage further assessed by authorized third party repair facility(within approximately two weeks from the time that the damaged rental is returned) . Final costs associated with damage will be the sole responsibility of the rente The renter is responsible for any and all losses and damages to Race Dream Jet Skis Rentals equipment while in their care, including but not limited to full cost of new replacement equipment, from causes including but not limited to trailering, launching, beaching or running around, collision with other boaters or objects on or below the water, running engine or systems out of fluids or with low fluids causing premature wear to mechanical systems, weather loss, dockage, anchoring, or any other cause whether or not the renter is directly at fault. You will be held responsible for all damages.

RENTER does hereby freely, voluntarily, and without duress execute this Release under the following terms and conditions:

1. WAIVER AND RELEASE. Renter does hereby release and forever discharge and hold harmless Lessor/ Owner and their respective agents, successors and assigns form any and all liability, claims, and demands of whatever kind or nature, whether in law or in equity, which arise or may hereinafter arise from Renter's use/ operation of equipment renter/ leased from Lessor/ Owner for water related activities. Renter understands that this Release discharges Lessor/ Owner from any liability or claim that Renter may have against Lessor/ Owner with respect to any bodily injury, personal injury, illness, death or property damage that may result from Renter's participation, use and operation of said Equipment and that Lessor/ Owner does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance. Renter is expected and encouraged to have medical or insurance in effect.

2. MEDICAL TREATMENT. Renter does hereby release and forever discharge Lessor/ Owner from any claim whatsoever which arises or may hereinafter arise on account of any first aid, treatment or service rendered in connection the Renter's participation and/or use/ operation of any Equipment or activities involving the use of equipment Renter receives from Lessor/Owner.

3. ASSUMPTION OF RISK. Renter understands that Renter's participation and use/ operation of equipment procured from Lessor/ Owner may include activities that may be hazardous to Renter and that water and weather conditions may be beyond the control of Lessor/ Owner. Renter expressly and specifically assumes the risk of injury or harm in those activities of Renter's participation with and/ or use/ operation of Equipment procured from/ through Lessor/Owner.

4. OTHER. Renter expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida. Should any litigation result from Renter's participation or use of equipment rented from Lessor/ Owner with Instructor, Renter agree venue in Orange County, Florida. Renter agrees that in the event any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction,the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

5. Cancellation Policy. Our cancellation policy is 72 hr prior the appointment
