I have decided to voluntarily participate in ice skating and to use the Enchant Skating Rink (the “Skating Rink”) at an Enchant Christmas Event (the “Event”). I understand and agree that ice skating involves known and unknown risks of injury to me and other people, which include but is not limited to: death, permanent or temporary paralysis, disability, illness, disease, physical or mental damage, or other injury, as well as damage to my equipment and personal property (all of these harms, including those not listed or unknown, are collectively referred to as “Harm” in the rest of this document). 

Some risks that may cause Harm include: falling; coming into contact with ice, ice boards, or other people; visible or hidden defects or conditions in the ice, equipment, or property; and intentional or unintentional acts and negligent acts by myself or other people, whether Event attendees or Event workers. I understand and agree that this list of risks is not complete and that other known or unknown risks may also cause Harm to myself, property, or other people. 

I voluntarily agree and promise, on behalf of myself and next of kin, to accept and assume all responsibility, financial or otherwise, for any injury, death, illness, damage, or any other Harm that happens to me or to my property because I chose to participate in ice skating. 

I also understand and agree that Enchant Christmas assumes no liability for any loss, damage, or any kind of injury or Harm to myself or my property while I use the Skating Rink and the surrounding facility and areas operated by Enchant Christmas (those places, the “Premises”), and the equipment provided by Enchant Christmas (the “Equipment”). The Equipment includes everything required to ice skate; for example, only, and not a complete list: the ice, ice boards, skates, and all machinery necessary to create and maintain the Skating Rink.

I voluntarily agree and promise to accept all risks related to using the Skating Rink, the Premises, and the Equipment even if they are caused by the negligence of Enchant Christmas, its employees, managers, officers, representatives, promoters, officials, advertisers, and property owners. I am choosing to ice skate voluntarily and no one is forcing me to participate even though there are serious risks. I understand that by signing this waiver and choosing to ice skate, I am agreeing to take full responsibility for all injury, death, and Harm and to voluntarily give up some of my legal rights.

By signing this waiver and release of liability and using the Skating Rink, the Premises, and the Equipment, I agree to fully and forever release from responsibility and agree to indemnify and hold harmless the following entities: Enchant Christmas LLC, Enchant Christmas Light Maze & Market Ltd., Shine Lighting Group USA, Inc., Shine Lighting Group Inc., IRE Crown Rinks, LLC, Salt River Fields at Talking Stick, Salt River-Pima Maricopa Indian Community and their respective partners, members, directors, officers, employees, agents, owners, licensees, divisions, affiliates and independent contractors (the “Released Parties”) from any and all Harm, liabilities, claims, demands, damages, rights of action, suits or causes of action, present of future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my use or intended use of the Skating Rink, the Premises and the Equipment, or otherwise arising out of my presence or activities at the Skating Rink and the Premises, even if arising from the negligence of the Released Parties. This paragraph is later referred to as the “Release.”

I am aware and agree that this waiver's validity spans Enchant's 2022 entire event cycle (November 30, 2022 - January 2, 2023), as opposed to only the date this document was signed

I understand and agree that the Released Parties are not responsible for any Harm to myself or my property. I understand and agree that by signing this document, I am giving up my legal rights to seek any compensation or reimbursement for any Harm to myself or my property, no matter how the Harm was caused.

I understand that this is a legal document. I am voluntarily agreeing and intend to be legally bound by this document.
