Tiny Tots Play Cafe, LLC Liability Waiver

I, the undersigned, the parent, legal guardian or assigned caretaker of the below listed minor (the “Minor”)​hereby ACKNOWLEDGE AND AGREE that the use of the TINY TOTS PLAY CAFÉ LLC facility and equipment has inherent risks. On behalf of myself and said Minor, I knowingly and freely assume all such risks, both known and unknown, including those that may arise out of the negligence of other participants.

I further acknowledge and agree that the TINY TOTS PLAY CAFÉ LLC employees does not assume any supervision of any child whatsoever while on the Premises and that the Parent, Caretake, legal guardian who accompanied the Minor on the premises shall at all times supervise and be solely responsible for the Minor.

I further agree that I shall comply with all posted safety signs, rules, and verbal instructions as conditions for participation in activities at TINY TOTS PLAY CAFÉ LLC. Further, TINY TOTS PLAY CAFÉ LLC EMPLOYEES shall have the authority to deny access, request that I and the Minor immediately leave the Premises, and/or call health officials if myself, my guests, or any accompanying minors fail to adhere to all posted safety signs, rules, and verbal instructions or show symptoms of illness that could be associated with COVID-19 or other like illnesses.

I understand that security cameras installed within and around the facility are for the safety of all participants and may be referenced should any incident or injury occur.

On behalf of myself, my heirs, representatives, executors, administrators, and assigns, ON BEHALF OF MYSELF AND AS PARENT,LEGAL GUARDIAN OR ASSIGNED THE MINOR, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS TINY TOTS PLAY CAFÉ LLC, its officers, agents, independent contractors, insurance companies, landlords, instructors and employees from any cause of action, claims, or demands of any nature whatsoever, including but not limited to, a claim of negligence, which my minor child or I, my heirs, representatives, executors, administrators, and assigns may now have, or have in the future against TINY TOTS PLAY CAFÉ LLC, on account of personal injury, property damage, death, or accident of any kind, arising out of or in any way related to my use of the TINY TOTS PLAY CAFÉ LLC facility and equipment, including but not limited to the interior play space, gym space, general parking lot, land area, and cafe area, whether that use is supervised or unsupervised, however the injury or damage is caused, including, but not limited to the negligence of TINY TOTS PLAY CAFÉ LLC its officers agents, independent contractors, instructors, insurance companies, landlords, instructors and employees.

Additionally, I hereby indemnify TINY TOTS PLAY CAFÉ LLC from any claim to illness that could be contracted in the community shared spaces throughout the facility. I understand that entering this facility is done so at my own risk and I do not and shall not hold TINY TOTS PLAY CAFÉ LLC responsible for contracting any illness that myself or any minor under my care may contract, be it either COVID-19 or any other illness.

I have read and understand the foregoing and executed this Waiver voluntarily and of my own free will.
