Yoga with Cheryl, and its principals, teachers, contractors, subcontractors, servants, agents, employees, teachers-in-training, apprentices, training teachers, mentoring teachers, visiting teachers, substitute teachers, and/or sessional teachers (hereinafter collectively referred to as “Cheryl Joseph”).

Assumption of Risks: Yoga Practice and COVID-19

Yoga Practice: I am aware that yoga practice, yoga classes, yoga workshops, yoga series, or other yoga activity, including, but not limited to, a free or donation-based yoga practice, class, workshop, series, or event (all of which may occur indoors, online/virtually, or outdoors), and yoga facilities including, but not limited to, yoga props, rope walls, and yoga furniture (hereinafter collectively referred to as the “Yoga Activities”), may involve inherent risks including but not limited to, personal injury, and expense and related loss, including loss of income. I am aware that one of the risks, dangers, or hazards of Yoga Activities is negligence on the part of Cheryl Jospeh or her students. I am also aware that one of the risks of my participation in Yoga Activities includes trip and fall situations.

COVID-19: COVID-19 is extremely contagious and is believed to spread mainly through the air and from person-to-person contact. I acknowledge that Cheryl Joseph will abide by all B.C. provincial health officer orders in place at any given time and agree to abide by these restrictions and any other safeguards Cheryl Joseph has put in place to reduce the risk of infection, including as those restrictions or safeguards change. I am aware that if I attend indoor or outdoor Yoga Activities in-person with Cheryl Joseph, I may become infected with COVID-19; and attending such Yoga Activities in-person could increase my risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected with COVID-19 by attending any indoor or outdoor Yoga Activities with Cheryl Joseph, and that such exposure or infection may result in personal injury, illness, disability, permanent disability, and death of myself or my close contacts. I understand that the risk of becoming exposed to or infected with COVID-19 at Cheryl Joseph's Yoga Acitvities may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Cheryl Joseph, her students, and their respective close contacts.

I FREELY ACCEPT AND FULLY ASSUME ALL SUCH YOGA ACTIVITIES AND COVID-19 RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF ILLNESS, PERSONAL INJURY, DEATH OR OTHER LOSS OF ANY KIND, AND EXPENSE AND RELATED LOSS, INCLUDING LOSS OF INCOME RESULTING THEREFROM*

In consideration of Cheryl Joseph accepting my registration and/or participation in the Yoga Activities, including ongoing or repeated participation in the same, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I, for myself, my heirs, my next of kin, executors, administrators, assigns, and representatives, agree:

1. TO WAIVE any and all claims, actions or causes of action, or complaints that I may have now or in the future against Cheryl Joseph;*

TO RELEASE and hold Cheryl Joseph harmless from any and all liability for any loss, damage, expense or related loss, including loss of income, personal injury, death, or illness of any kind that I may suffer, or that my next of kin may suffer, as a result of my participation in the Yoga Activities, due to any cause whatsoever, including negligence, breach of contract, breach of a statutory duty, or other duty of care, on the part of Cheryl Joseph, including the failure of Cheryl Joseph to safeguard or to protect me from the risks, dangers, and hazards of Yoga Activities or COVID-19; and*

3. TO INDEMNIFY and hold Cheryl Joseph harmless from any and all liability and property damage or personal injury of any kind to any third party resulting from my participation in the Yoga Activities.*

This Agreement is effective and binding upon not only myself, but my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO SIGNING IT AND THAT I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES MAY HAVE AGAINST CHERYL JOSEPH.*
