To: CITY CENTRE PARK, and Performance Plus Hockey Inc., the City of Langford, and their respective subsidiaries, affiliates, directors, officers, shareholders, agents, employees, guides, contractors, subcontractors, representatives, successors and assigns (collectively referred to as “City Centre”)

Re: Participation at the Playzone indoor playground

IN THIS AGREEMENT, “Activities” means the activity described above together with all other activities, events or services provided, arranged, organized, conducted, sponsored, provided or authorized by City Centre.

I. ASSUMPTION OF RISK

1.1 I agree that City Centre will not permit me to participate in any Activities unless I sign this Agreement.

1.2 I acknowledge that City Centre is not required to and may not actively monitor any Activities.

1.3 I understand that the Activities may expose me to risks, dangers, and hazards, whether or not known or anticipated, which could result in damage or loss to my own or other’s property, serious physical or emotional injury, paralysis or death, and without limitation including COVID-19 exposure, and the possibility of personal injury or death resulting from COVID-19 infection (collectively, the “Hazards”). I understand that Hazards cannot be eliminated from Activities.

1.4 I understand that human error and negligence on the part of persons involved in preparing, organizing and leading or guiding any of the Activities could result in a failure to safeguard or protect me from the Hazards. Although City Centre and those for whom they are responsible will make reasonable efforts to minimize exposure to Hazards, I have a personal responsibility to learn and follow safety rules and procedures established by City Centre, and to make them aware at any point when I question my knowledge of those procedures or my ability to participate in any of the Activities.

1.5 I acknowledge that my Activities reservation is subject to cancellation without notice where directed or required by municipal or provincial authority, or where City Centre determines that use of the facilities poses an unreasonable health risk. If City Centre cancels your reservation because of increased health risk, your deposit will be refunded. You will otherwise have no claim against the City Centre for any resulting damages, whether direct or indirect.

1.6 I am aware of, and fully assume and accept, the Hazards and the possibility of personal injury, death, property damage, or any resulting loss.

II. RELEASE, WAIVER, AND INDEMNITY

IN CONSIDERATION of City Centre allowing me to participate in the Activities:

2.1 I agree to waive all claims that I have or may have against City Centre. I release City Centre from all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, resulting from my preparation and participation in any of the Activities, resulting from any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, on the part of City Centre or anyone for whom City Centre is in law responsible, including failure on the part of City Centre to safeguard or protect me from any Hazards.

2.2 I agree to hold harmless and indemnify City Centre (a) from any and all liability for any damage to property of or personal injury to any third party, resulting from my presence during or participation in any of the Activities; and (b) from any and all emergency expenses related to first aid or medical treatment or evacuation of myself in the event of an accident, injury, or illness (and I consent to receiving all such treatment.) I agree that all expenses associated with any evacuation, rescue, or first aid will be my responsibility and will not be paid by City Centre.

3 GENERAL ACKNOWLEDGEMENTS

3.1 I have read and understood this Agreement. I am aware that by signing this instrument I am waiving certain legal rights which I may have against City Centre or any one for whom City Centre is responsible.

3.2 ACKNOWLEDGEMENT OF A GUARDIAN OR PARENT: I am the parent or guardian of the participant(s) named below (the “Child”). have read this Agreement. I understand, appreciate, freely accept and fully assume the Hazards. On my own behalf and on behalf of the Child, I release City Centre and any one for whom City Centre is in law responsible from any and all liability, for any loss, damage or expense that the Child or I may sustain as a direct or indirect result of the Child’s participation in the Activities, and I agree not to sue or commence any legal proceedings against City Centre or any one for whom City Centre is in law responsible for any loss, damage, injury or expense resulting from my participation in the Activities. I also agree to indemnify and save City Centre harmless from any all liability for any property damage of, personal injury to, or death of the Child in, any of the Activities.
