Terms & Conditions Form & Booking Agreement

 

This is a legal document 

 

I hereby

ASSUME ALL OF THE RISKS OF PARTICIPATING desires to rent from The Plug Party Rentals LLC,  equipment to be used by renter, his/her guests, or other people while in renter’s possession . Renter understands the use of this play equipment may, by its nature, cause injury or harm to renter, his/her guests, or other people. 

 

 

The Plug Party Rentals LLC RULES: It is the responsibility of the person/s or organization hiring The Plug Party Rentals LLC to ensure that all possible precautions are taken to avoid injury to people or damage to The Plug Party Rentals LLC

 

The Plug Party Rentals LLC  usually requires 1 hour before your event start time to set up equipment and up to 1 hour after your event booking time to pick up equipment.

 

In order to secure your event date, there is a NONE refundable $150 deposit that goes towards the event final balance. 

Cancellations of the event date agreed on policy

8-13 days before the event date will result in a cancellation fee of $100. Cancellations of the event date agreed on 0- 7 days before the event date will result in the loss of the $150 deposit.

No changes to date, location, times, or rental equipment can be made within 7 days of the event.

 

• Please do not allow your attendees in the set up space during set-up and pick-up of equipment.

 

• Minors must be supervised at all times.

 

• All players to comply with all safety rules and direction of the attendant.

 

• Player's waiver must be filled out before interactions on the equipment. 

 

• Shoes must be worn for protection. 

 

• No food, candy, gum, or beverages in the play area.

THIS INCLUDES WATER. 

 

• Equipment shall not be removed from the play area.

 

• No pushing, shoving, wrestling, horseplay, or fighting during the game.

 

• All sharp objects must be removed before entering the play area. 

 

• NO pets of any kind in the bunkers.

 

• Area to be clear of any saftey concerns including wet surfaces.

 

We require a flat surface that is dry and free of uneven grass, holes,  major rocks, mud,  major debris, etc. in order for us to set up the rental equipment. If your rental will be on grass, please mow prior to the event in order to ensure a flat surface.

 

Weather: The laser play equipment is made of material that can become quite hot and or shut down if in direct sunlight. We will not set up outside if it is raining or if there is a chance of rain. If there is rain in the forecast for the day of your event, we will work with you to find a place inside to set up if the area inside allows it or we can offer a credit that is valid up to one year from original booking. No refund will be given if outdoor parties are unable to proceed due to wet weather.

 

please note all special logistics of set ups is required to discuss with coordinator prior: such as small walkways , stairs and elevators. All equipment requires a wide walkway that allow a dolly with possible heavy equipment. if any of these special requirements reflect your space for unload please disclose prior to set up as they will acquire a minimum fee of $60-$150 per install and pick up . we also require a empty space on the street temporarily for drop off and pick up for our trailer. 

 

WAIVER AND RELEASE: Renter understands and acknowledges that this RELEASE discharges The Plug Party Rentals LLC. from any liability or claim that the renter may have against The Plug Party Rentals LLC. with respect to any bodily injury, illness, death or property damage that may result from Renter’s use and possession of The Plug Party Rentals LLC. Renter does hereby release and will forever discharge and hold harmless The Plug Party Rentals LLC. and its successors and assigns from any and all liability claims, and lawsuits of any kind or nature either in law or in equity, which arise or may hereafter arise from Renters possession and use of The Plug Party Rentals LLC equipment. 

 

INSURANCE: Renter understands that insurance for liability, health and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of Renter. 

 

By signing below, I, and my guests forfeit all rights to bring a suit against The Plug Party Rentals LLC. and affiliates for any reason. In return, I will also make every effort to obey safety precautions as listed in writing and explained to me verbally, in efforts to keep the The Plug Party Rentals LLC experience positive. I have heard the safety rules and understand that I will ask for clarification when needed. 

 

EQUIPMENT CLEANLINESS AND CARE: 

A disinfectant will be provided by The Plug Party Rentals LLC to ensure proper sterilization that is safe for all, including the equipment. If there is any damaged or stolen play equipment renter will be charged at an appropriate amount, i.e. cost of repair or replacement up to $2000 per item. A picture will be taken at the time of the event starting for any possible disputes. 

 

Authorization: I/We agree to any film or photographs of me/us as a participant becomes your property and may be used for promotional purposes. If any specific person or item does not want to be in the footage for privacy reasons (VIP's Privacy Concerns ETC) please let us know in advance. 

 

 

I CERTIFY THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY FORM AND I FULLY UNDERSTAND ITS CONTENT.  I AM AWARE THAT THIS RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

 

I, HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING The Plug Party Rentals LLC , including but not limited to any risk that might arise from negligence or carelessness on the part of the persons or entities being released, because of their possible liability without fault, or from danger to any real or perceived exposure to COVID-19 virus through participation in this  event and/or future events held by The Plug Party Rentals LLC  and not limited to outside events, but including events held inside the building of The Plug Party Rentals LLC as well.

 

I certify that I am physically well, I do not have any symptoms of COVID-19 and no qualified medical professional has advised me (us) to not participate or to stay home in quarantine or isolation.  I certify that there are no health-related reasons or problems which preclude my participation in this activity, and or future events by The Plug Party Rentals LLC.

 

I WAIVE, RELEASE, AND DISCHARGE, The Plug Party Rentals LLC  and their directors, officers, employees, volunteers, representatives, and agents from any and all liability, including but not limited to, liability arising from negligence or fault of the agents of The Plug Party Rentals LLC  or other participants of The Plug Party Rentals LLC, for any real or perceived exposure to COVID-19, illness, death, disability, personal injury, property damage, or actions of any kind which hereafter occur to me at any time including during my (our) travel to and from this activity.

 

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this Waiver and Release from Liability form from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.  I acknowledge that The Plug Party Rentals LLC  is NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting specific activity on their behalf and The Plug Party Rentals LLC is not responsible for any real or perceived exposure to COVID-19.

 

I acknowledge that this activity may involve direct physical contact with individuals other than my (our) immediate family and/or household members.  I acknowledge that I am attending The Plug Party Rentals LLC of my (our) own free will and The Plug Party Rentals LLC  and their directors, officers, employees, volunteers, representatives, or agents did not force or compel me to attend.  I acknowledge that I (we) have been and will again be in public places, businesses, and in the presence of individuals other than those in my (our) household before and after this The Plug Party Rentals LLC event .

 

This waiver and release of liability shall remain in effect for the duration of my (our) participation in this initial Event  and all subsequent Events.  This Waiver and Release from Liability form shall also apply to all minors and persons in my (our) legal care, custody, and control attending The Plug Party Rentals LLC events.  This Waiver Release from Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible and governed by the laws of the State of California and supersedes any and all previous oral or written promises or agreements.

 

I acknowledge this Waiver and Release is reasonable, valid, and enforceable.  However, if any term, covenant, condition, or provision of this Waiver and Release is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the intent of all parties that such provision is severable and the remainder of this Waiver and Release will in no way be affected, impaired, or invalidated as a result.
