Petals & Confetti Rental Agreement Waiver

This is a legal document ,

I hereby ,
ASSUME ALL OF THE RISKS OF PARTICIPATING desires to rent from Petals & Confetti,LLC.,  equipment to be used by renter, his/her guests, or other people while in renter’s possession 
. Renter understands the use of this play equipment may, by its nature, cause injury or harm to renter, his/her guests, or other people. 

WAIVER AND RELEASE: Renter understands and acknowledges that this RELEASE discharges Petals & Confetti,LLC. from any liability or claim that the renter may have against Petals & Confetti,LLC. with respect to any bodily injury, illness, death or property damage that may result from Renter’s use and possession of Petals & Confetti,LLC. equipment. Renter does hereby release and will forever discharge and hold harmless Petals & Confetti,LLC. and its successors and assigns from any and all liability claims, and lawsuits of any kind or nature either in law or in equity, which arise or may hereafter arise from Renters possession and use of Petals & Confetti,LLC. equipment. 

INSURANCE: Renter understands that insurance for liability, health and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of Renter. 

By signing below, I, and my guests forfeit all rights to bring a suit against Petals & Confetti,LLC. and affiliates for any reason. In return, I will also make every effort to obey safety precautions as listed in writing and explained to me verbally, in efforts to keep the Petals & Confetti,LLC. experience positive. I have heard the safety rules and understand that I will ask for clarification when needed. 

EQUIPMENT CLEANLINESS AND CARE: To reduce the number of germs and therefore the spread of disease or illness we ask that you immediately disinfect any equipment that has come in contact with the following situations: Leaked or soiled diapers, vomit, blood, or mucus. At the time of pick up, if the equipment is in extremely dirty condition, the renter will be charged a $150 cleaning fee. If there is any damaged or stolen play equipment renter will be charged at an appropriate amount, i.e. cost of repair or replacement. 

RULES: It is the responsibility of the person/s or organization hiring Petals & Confetti,LLC. to ensure that all possible precautions are taken to avoid injury to people or damage to Petals & Confetti,LLC.

• Children must be supervised at all times 

• NO SHOES / NO HEELS are permitted inside the play area. (ADULTS INCLUDED) 

• NO diving or throwing balls out of the ball pit. Clean up fee of $75 will apply for excessive amount of balls outside of ball pit area. 

• NO food, candy, gum, or beverages in the soft play/inflatables. This may avoid choking and keep rentals clean.

• Equipment shall not be removed from the soft play area. 

• Only children from the ages of 0-5 years old may play in the soft play area. 

• NO facepaint, party poppers or mess prone products inside the play area or inflatables (i.e. glitter, slime, silly string, messy art, temporary tattoos/stickers, etc.) 

 All sharp objects must be removed before entering the play area. 

ATTENDANT: It is the responsibility of the person/s or organization hiring Petals & Confetti,LLC. to ensure that all possible precautions are taken to avoid injury to people or damage to Petals & Confetti,LLC. items. Petals & Confetti,LLC. attendants are not liable for the safety of the children and parental supervision is advised at all times. Petals & Confetti,LLC. attendants are strictly hired to enforce proper use of the Bubble House and assist with operations of the rental item to ensure ease at your event. 

Please note we do not move our set ups once they are set up and clients are not permitted to move rentals.

Please note we do not permit the renter to attach any items to the rentals (i.e. stickers, vinyl, balloons, balloon garland, ribbon, tinsel, fringe, etc.) unless provided and attached by Petals & Confetti,LLC. or approved beforehand. 

Please note all special logistics of set ups is required to discuss with coordinator prior: such as small walkways, stairs, and elevators. All equipment requires a wide walkway that allow a dolly with heavy equipment. If any of these special requirements reflect your space for unload please disclose prior to set up.

Please note we do not set up in the rain. Some of our rentals can be set up inside incase of rain. Inflatables cannot be set up when winds are over 15-20 mph for your safety. Bubble Houses require a shaded area when tempuratures are above 75 degrees fahrenheit. We do not set up on gravel, rocks, or dirt. Set-up area must be flat.

Petals & Confetti,LLC. has the right to cancel if weather does not permit set-up or if set-up area does not meet the requirements. 

Petals & Confetti,LLC. requires that you cancel at least 72 hours in advance. All deposits are non-refundable and store credit will not be given. If paid in full and a cancelation is made at least 72 hours prior, a refund will be issued, except for the non-refundable deposit ($100 per rental item booked). 

Petals & Confetti,LLC. is not resposible for any damage to underground utility lines/devices(such as but not limited to eletrical,plumbing,sprinklers etc) The Renter is to notify Petals & Confetti LLC. where rentals are to be set up, and have utility lines marked prior to set up.

I CERTIFY THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY FORM AND I FULLY UNDERSTAND ITS CONTENT.  I AM AWARE THAT THIS RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

I, HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING Petals & Confetti,LLC., including but not limited to any risk that might arise from negligence or carelessness on the part of the persons or entities being released, because of their possible liability without fault, or from danger to any real or perceived exposure to COVID-19 virus through participation in this  event and/or future events held by Petals & Confetti,LLC.  and not limited to outside events, but including events held inside the building of Petals & Confetti,LLC. as well.

I certify that I am physically well, I do not have any symptoms of COVID-19 and no qualified medical professional has advised me (us) to not participate or to stay home in quarantine or isolation.  I certify that there are no health-related reasons or problems which preclude my participation in this activity, and or future events by Petals & Confetti,LLC.

  1. I WAIVE, RELEASE, AND DISCHARGE, Petals & Confetti,LLC.  and their directors, officers, employees, volunteers, representatives, and agents from any and all liability, including but not limited to, liability arising from negligence or fault of the agents of Petals & Confetti,LLC.  or other participants of Petals & Confetti,LLC. for any real or perceived exposure to COVID-19, illness, death, disability, personal injury, property damage, or actions of any kind which hereafter occur to me at any time including during my (our) travel to and from this activity.

  2. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this Waiver and Release from Liability form from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.  I acknowledge that Petals & Confetti,LLC.  is NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting specific activity on their behalf and Petals & Confetti,LLC.  is not responsible for any real or perceived exposure to COVID-19.

I acknowledge that this activity may involve direct physical contact with individuals other than my (our) immediate family and/or household members.  I acknowledge that I am attending Petals & Confetti,LLC. of my (our) own free will and Petals & Confetti,LLC.  and their directors, officers, employees, volunteers, representatives, or agents did not force or compel me to attend.  I acknowledge that I (we) have been and will again be in public places, businesses, and in the presence of individuals other than those in my (our) household before and after this Petals & Confetti,LLC. event .

This waiver and release of liability shall remain in effect for the duration of my (our) participation in this initial Event  and all subsequent Events.  This Waiver and Release from Liability form shall also apply to all minors and persons in my (our) legal care, custody, and control attending Petals & Confetti,LLC. events.  This Waiver Release from Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible and governed by the laws of the State of California and supersedes any and all previous oral or written promises or agreements.

I acknowledge this Waiver and Release is reasonable, valid, and enforceable.  However, if any term, covenant, condition, or provision of this Waiver and Release is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the intent of all parties that such provision is severable and the remainder of this Waiver and Release will in no way be affected, impaired, or invalidated as a result.

I CERTIFY THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY FORM AND I FULLY UNDERSTAND ITS CONTENT.  I AM AWARE THAT THIS RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
